Terms & Conditions

These Terms & Conditions (“Terms”) govern rentals and services provided by Party Expo LLC (“Party Expo,” “we,” “us,” or “our”). By requesting a quote, placing a reservation, or accepting delivery, you agree to these Terms. These Terms supplement — and do not replace — any separate written rental agreement you sign at the time of booking; if there is a conflict, the signed agreement controls.

To lock in your date, payment in full — 100% of the rental price — is due at the time of booking. Your date is not reserved until payment is received.

In addition, a refundable security (damage) deposit equal to 20% of your total rental is collected with your booking. The security deposit is returned after your event as described in Section 7.

Accepted payment methods are provided with your quote. All prices are exclusive of New Jersey sales tax, which is added where applicable. Returned or declined payments may be subject to additional fees.

Because your date is reserved with payment in full, cancellations are eligible for a partial refund on a sliding scale based on how far in advance you cancel — the earlier you cancel, the more of your payment is refundable. You may instead choose to reschedule to a later date, subject to availability. The specific cancellation and rescheduling schedule for your booking is set out on your quote and invoice.

The refundable security deposit (Section 7) is returned in full when you cancel, since it relates only to equipment condition. We may also cancel a booking due to weather, safety, events beyond our control, or non-payment (see Sections 8 and 14); in those cases we will offer a reschedule or refund as set out in those sections.

Delivery, setup, and breakdown are included in the rental price for the areas we serve. You are responsible for ensuring the delivery site is accessible, safe, and ready at the agreed time, including clear access, adequate space, and identification of underground utilities or sprinkler lines before staking.

If our team cannot complete delivery or setup because the site is inaccessible, unsafe, or not ready, or no authorized person is present, a return-trip or inaccessible-site fee may apply.

All equipment remains the property of Party Expo at all times. You may not move, modify, sublet, or relocate equipment without our consent.

You are responsible for the safe and proper use of all rented equipment from delivery until pickup, including adult supervision where appropriate and following any safety instructions we provide. You agree to use the equipment only for its intended purpose.

You are responsible for all rented equipment from delivery until pickup. Your 20% security deposit is refunded in full after your event, provided the equipment is returned in good condition and has not been damaged, lost, or mishandled.

Equipment that is damaged beyond normal wear, lost, or stolen is billed at full replacement cost, and items returned excessively soiled may be subject to a cleaning fee. These charges are deducted from your security deposit, with any remaining balance refunded to you; if charges exceed the deposit, the difference is billed separately.

For outdoor events, we monitor conditions and reserve the right to delay, relocate, or cancel setup in cases of adverse weather — including high winds, lightning, or heavy rain — when we determine it is necessary for safety. Weather-related cancellations may be rescheduled or refunded at our discretion. Frame tents are weather-resistant but are not designed for severe-weather shelter.

Where a permit is required by your municipality (for example, for event tents, generators, or large gatherings), we provide permit assistance, but the customer remains responsible for ensuring required permits are in place. We are not liable for fines or shutdowns resulting from missing permits the customer was responsible for.

Party Expo carries general liability insurance, and a Certificate of Insurance is available on request for parks, schools, and corporate venues. Some venues require the customer to carry their own event insurance; meeting any such venue requirement is the customer's responsibility.

You acknowledge that the use of party and event equipment carries inherent risks and you assume responsibility for the safe use of the equipment at your event. To the fullest extent permitted by law, our total liability arising out of any rental or service is limited to the amount you paid for that rental, and we are not liable for indirect, incidental, or consequential damages.

You agree to indemnify and hold harmless Party Expo, its owners, and employees from any claims, damages, injuries, or expenses arising out of your event or your use of the rented equipment, except to the extent caused by our gross negligence or willful misconduct.

We may photograph or record our equipment and setups at your event for quality and marketing purposes. If you prefer we not use images of your event, let us know in writing before the event date and we will honor your request.

We are not responsible for failure or delay in performance caused by events beyond our reasonable control, including severe weather, natural disasters, utility or supply failures, labor disruptions, or government actions. In such cases we will work with you to reschedule or issue a fair refund.

We reserve the right to substitute comparable equipment of equal or greater value when a specific item is unavailable, without reducing the quality of your event.

These Terms are governed by the laws of the State of New Jersey. Any dispute will be brought exclusively in the state or federal courts located in Union County, New Jersey.

We may update these Terms from time to time. The version in effect on the date of your booking applies to your rental. The “last updated” date above reflects the most recent revision.

These Terms, together with your signed rental agreement and quote, are the entire agreement between you and Party Expo. If any provision is found unenforceable, the remaining provisions stay in full effect.
